1. Introduction

Welcome to Subller ("we," "our," "us"). These Terms of Service ("Terms") govern your access to and use of our website, www.subller.com (the "Site"), and any purchases you make from us.

By accessing our Site and purchasing physical goods (t-shirts, mugs, and other merchandise) from us, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to all of these Terms, you may not access the Site or use our services.

2. Products

  • Description: We strive to display the colors, designs, and descriptions of our t-shirts, mugs, and other products as accurately as possible. However, we cannot guarantee that your monitor's display of any color will be accurate. All products are subject to availability, and we reserve the right to discontinue any product at any time.

  • Errors: In the event of an error on our Site, in an order confirmation, in processing an order, or in product pricing, we reserve the right to correct the error and revise your order accordingly, or to cancel the order and provide a full refund.

  • Personal Use: All products are for personal, non-commercial use only. You may not resell our products.

3. Orders and Payment

  • Order Acceptance: Your order is an offer to purchase our products. All orders are subject to acceptance by us. We may refuse or cancel an order for any reason, including limitations on quantities available, inaccuracies in product information, or issues identified by our fraud prevention department.

  • Pricing: All prices are in US Dollars (USD). We reserve the right to change prices at any time without notice. Shipping and handling costs will be added to your order total and are clearly displayed at checkout.

  • Payment: You agree to pay the total amount for the products you purchase, including all applicable taxes and shipping fees. Payment must be made through one of our accepted payment gateways at the time of purchase.

4. Shipping and Delivery

  • Processing: Please allow 2-5 business days for order processing and production before shipment.

  • Shipping Times & Costs: Shipping times and costs are estimates and are not guaranteed. Delivery dates may be affected by factors beyond our control, such as carrier delays or customs hold-ups. You can find our detailed shipping policy on our Shipping Information page.

  • Title and Risk: Title and risk of loss for all products pass to you upon our delivery of the items to the carrier (e.g., USPS, UPS, FedEx).

5. Returns, Exchanges, and Refunds

  • Policy: Due to the custom/personalized nature of many of our products, we generally do not accept returns or exchanges unless the item is defective or we made an error in your order.

  • Defective or Damaged Items: If you receive a defective or damaged item, please contact us within 14 days of delivery at info@subller.com with your order number and photos of the issue. We will happily replace the item or issue a refund at our discretion.

  • Refunds: Refunds, if granted, will be issued to the original payment method. Please allow 5-10 business days for the refund to process.

6. Intellectual Property

All designs, logos, graphics, text, and other content on the Site and on our products are the intellectual property of Subller or our licensors and are protected by copyright, trademark, and other laws. You may not use, reproduce, or distribute any content from the Site or our products without our express written permission.

7. User Accounts

If you create an account on our Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account.

8. Prohibited Uses

In no case shall Subller, our directors, officers, employees, or affiliates be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of the Site or any products procured using the Site.

You agree to indemnify, defend, and hold harmless Subller and our parent, subsidiaries, affiliates, partners, officers, directors, agents, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms.

11. Changes to Terms of Service

We reserve the right to update, change, or replace any part of these Terms of Service by posting updates and changes to our Site. It is your responsibility to check our Site periodically for changes. Your continued use of or access to the Site following the posting of any changes constitutes acceptance of those changes.

12. Governing Law

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of United States, New Mexico, without regard to its conflict of law principles.
